General Terms and Conditions for REUGE’s e-shop

REUGE SA (hereinafter “REUGE”) is a Swiss company manufacturing music boxes, singing birds and watches. Its registered office is at 26 rue des Rasses, CH 1450 Sainte-Croix. These General Terms and Conditions apply to any sales made through the REUGE’s e-shop by any Customer, i.e. any individual or legal entity anywhere in the world Article 1: Applicability 1.1 Scope of applicationThese General Terms and Conditions apply to any sale transaction carried out with REUGE through its e-shop. The Customer agrees and fully accepts the validity and contents of these Terms and Conditions.
2.1 GeneralThe specificities and technical features of the products manufactured by REUGE, i.e luxury music boxes, singing birds and watches, are described on our website http://www.REUGE.com and in our brochures and commercial documents that are available by downloading or on demand by postal mail. 2.2 Modification of the products’ specificitiesREUGE endeavors to ensure to its Customer a perfect compliance of the products effectively delivered to the Customer with their descriptions and appearances on the website.
However,
minor differences on quality, color, width, weight or finishing shall not entitle
the Customer to any compensation nor price reduction. Article 3: Delivery 3.1 Mode of deliveryREUGE reserves the right to choose the most suitable shipping means. Delivery will normally be made by post to a Swissthe Customer and by UPS express to foreign Customers within 68 weeks from reception of the order unless indicated differently. REUGE is not liable for any delay which is due to strike, lock out, “force majeure” or operational breakdown in REUGE’s or any of its ancillary supplier’s enterprises which are not caused due to REUGE’s fault. 3.2 Geographical scope of deliveryThere is no restriction as to the scope of delivery. However, REUGE may refuse to deliver to a part of the world if the delivery conditions are not satisfying. 3.3 InsuranceREUGE insures the delivery unless instructed otherwise by the Customer until reception of the shipment by the Customer. Article 4: Orders 4.1 E-shop orderAn e-shop order is placed in [9] steps: a) Creation of a Customer account; b) Activation of the Customer account; c) Selection of the products; d) Overview and Confirmation of the order; e) Acceptance of the General Terms and Conditions for online orders and delivery; f) Confirmation of the delivery address and selection of delivery mode (through the priority postal service or with private carrier); g) Confirmation of the billing address and selection of payment mode; h) Final Confirmation of the order, including submission of final invoice and delivery charges; i) E-mail confirmation of the order; 4.2 PaymentPayments are made by credit card and Postcard (Switzerland) only. Most standard credit cards are accepted. 4.3 PricesOur prices are published in the REUGE’s e-shop. The price shown in REUGE’s e-shop is relevant. Product prices shown on the REUGE’s e-shop are in Swiss Francs; Euros or US$ depending on the invoicing address excluding delivery charges, local taxes and custom duties. Delivery charges are included in the final amount as given in step fh). For Customers located in Switzerland, the price appearing in step fh) includes the Swiss VAT (value tax added, 7.6 %). REUGE will not charge the Swiss VAT for products sold and shipped abroad. The price as shown in step fh) will therefore not include the Swiss VAT. Other taxes and charges are not included in the above-mentioned sub-total. 4.4 Other Taxes and ChargesThe national customs duties applicable to Customers requesting a delivery abroad are separately payable by the Customer, on the top of all the above-mentioned fares. Each Customer is therefore responsible for his or her own obligations to pay sales taxes, import taxes, customs duties and other fees and taxes as may be applicable in his or her jurisdiction. Customers are required to provide truthful information on their purchases and applicable tax obligations. 4.5 Credit card chargesA flat charge to cover credit card costs might be payable if indicated on the website and mentioned on the delivery confirmation. 4.6 CurrencyFares, taxes and charges are payable in the currency in which the price is published unless otherwise agreed by REUGE. Article 5: Warranty, repair and exchange conditions 5.1 General warranty’s principleEach REUGE product purchased through its e-shop is guaranteed by REUGE SA to be free from any defects in material and workmanship under normal use for a period of 2 years from the date of purchase.

has been subjected to numerous technical checks during its manufacture to
ensure it corresponds to the traditional level of quality required by Reuge. To make use of the guarantee, in case of any incident during this period, please contact the manufacturer Reuge. You will need your guarantee card, which has been filled out at the time of purchase. Limitation This guarantee is limited to the replacement of defective parts by our craftsmen. The guarantee is only valid if the stamp of the manufacturer Reuge, as well as the date of purchase are on the card. If the card is not joined to the music box, Reuge will invoice the costs of repair and shipment and can require their prepayment. 5.2 Inspection and reception of the productThe Customer shall inspect the product upon reception and shall, within 5 days, notify REUGE in writing of any deficiencies, clearly indicating the product identification number stated in the certificate of warranty. In the absence of such notification, the product is deemed accepted by the Customer. The Customer who detects a malfunction after the delivery but during the period of warranty shall within 5 days notify REUGE in writing of the deficiencies. Upon notification of the defect, REUGE will therefore issue an “authorization” to the Customer, allowing the Customer to send the product back to REUGE. Please note that REUGE cannot accept defect products without the prior “authorization”. Without evidence of such “authorization”, shipments can not be accepted by REUGE. After having notified REUGE on the deficiencies and upon reception of the above-mentioned authorization, the Customer shall send the product back to REUGE, using safe delivery services with shipment costs at his own expense. REUGE shall not be held responsible for damages occurring during the shipment. 5.3 Repair and Limited Warranty for Mechanical Music boxes, singing birds or WatchesIn the event that, after due notification, defects are detected by REUGE on the delivered product, REUGE shall at its own discretion: - Replace the product; or - Repair and deliver the product; 5.4 Repairs not covered by warrantyThe Customer is welcome to contact the REUGE Customer service for repairs or services after expiry of the warranty period, or where these are not covered by the warranty. REUGE will check the object and send the Customer a cost estimate with no obligation. The repair costs will then be invoiced to the Customer and REUGE can require their prepayment.
Article 6: Miscellaneous
6.1 Applicable lawThe online Contract of Sale concluded by a customer using the REUGE e-shop shall be governed by Swiss Law. 6.2 Choice of JurisdictionAny dispute arising out of this contract of carriage shall be subject to the exclusive jurisdiction of Geneva (Switzerland). The United Nations Conventions on Contracts for the International Sale of Goods (“Vienna Convention” dated 1st of April 1980) is not applicable to the present Terms and Conditions for REUGE’s e-shop.
