Scope
1.1 This privacy policy applies to all data collected, exchanged or disclosed in whatever way when using Reuge’s website.
1.2 By using Reuge’s website, the visitor agrees to this privacy policy.  

Use and storage of data
2.1 Reuge collects, uses and stores some non-personal data of the visitor of its website for analysis and statistical purposes in order to improve its offers. This data does not allow personal identification of the visitor.
2.2 Reuge collects, stores and processes the data in Switzerland anonymously and for its own account. The data is not made available to third parties, except for Reuge’s partners in the handling of the products. The data may be transferred to data centers abroad for storage purposes only. The visitor’s data is in principle stored for a maximum of 5 years.  

Access and security measures
3.1 Reuge guarantees the timely portability of the data at the visitor’s first request insofar as the data is identifiable.
3.2 Reuge complies with Swiss and European regulations on data security and data protection and undertakes all appropriate measures to preserve data security. However, due to the nature of Internet, Reuge cannot guarantee a 100% security or invulnerability of the data communicated to it through digital means of communication.  

Data Protection Officer
4.1 Visitors might request access to their personal data by sending an email to DPO[at]reuge.com. The access to the data is granted if and insofar as Reuge has an adequate proof of identity and if and insofar as the collected data is clearly and unequivocally attributable to the visitor making the request.

Cookies
5.1 Reuge uses cookies to provide to the visitors of its website a better browsing experience. By browsing through Reuge’s website, visitors have agreed to the use of cookies. Reuge’s use of cookies is in accordance with this privacy policy. Reuge uses cookies for the sole purpose of providing services to its customers. Cookies are never used to trace IP addresses or identify a visitor.
5.2 Reuge uses Google Analytics to better understand the traffic on its website, to optimize its performance and thus to facilitate and to optimize visitor’s access to on-line data and to enhance the browsing experience.
5.3 Each visitor can adjust the management of cookies in his browser settings (see Terms of Use and Cookies).  

Applicable law and venue
6.1
The contract between the customer and Reuge is exclusively governed by the substantive laws of Switzerland excluding the provisions of private international law (with the exception of art. 116 of the Swiss Federal Law on Private International Law, which allows this choice of law) and to the exclusion of  the Vienna Convention on the International Sale of Goods.
6.2 Exclusive venue is with the competent courts of Reuge’s headquarters (Sainte-Croix (VD), Switzerland). However and notwithstanding the aforesaid, Reuge is also entitled to sue the customer at the competent court of his residence or at any other court.

Terms & Conditions of Sale
Scope
1.1
All sales and deliveries executed over Reuge’s E-Boutique https://www.reuge.com/shop / are governed by the present general terms and conditions as amended from time to time. Other terms and conditions contradicting the present clauses are not applying to the relationship between Reuge and the customer. This privacy policy applies to all data collected, exchanged or disclosed in whatever way when using Reuge’s website.
1.2 The term “Consumer” refers to physical persons ordering goods for purposes other than professional or commercial purposes.

Download, confirmation and use of data
2.1 The user is enabled to download and print the present terms and conditions through https://www.reuge.com/shop/.
2.2 The orders are confirmed automatically through e-mail sent to user’s e-mail address and can be saved and printed out. The confirmation contains all relevant data of the purchase order.
2.3 The data the user is submitting is stored by Reuge. Due to data protection, the user does not have direct access to his/her data unless registered as “Registered user”. “Registered users” have access to their personal data and have the possibility to follow the status of their past or pending orders. “Registered users” also have the possibility to change the data and to subscribe to or to unsubscribe from the newsletter.
2.4 Reuge keeps the users’ personal data and access codes strictly confidential according to its data protection policy.

Access and use of the E-Boutique
3.1 he user of the E-Boutique is responsible for providing his/her personal data truly and comprehensively if requested to do so. The user shall keep his/her access codes confidential and is solely responsible to grant no unauthorized third party access to it. The orders with the user’s personal data are binding upon user.
3.2 Reuge is not obliged (i) to accept or register users, (ii) to grant access to its E-Boutique or (iii) to have a permanent availability of its products, even if they are marked as available in the E-Boutique.
3.3 Reuge makes its best efforts to keep the E-Boutique continuously accessible and available. However and namely due to maintenance works, the E-Boutique might be temporarily unavailable. Reuge can further not grant the consistency and accuracy of the data and of product descriptions and is under no circumstances responsible for any data loss whatsoever.

Binding orders
4.1 By clicking the button “confirm“, the user gives a binding order to Reuge regarding the goods in his/her shopping basket/cart. The confirmation of the order with payment details is sent to user’s registered e-mail address.
4.2 Reuge’s webpage contains under no circumstance binding offers and nothing on Reuge’s webpage shall be interpreted as such. Reuge is bound by the order upon dispatch of the ordered goods only.
4.3 Reuge dispatches the goods after receipt of full payment of the purchase price only. If the payment is not received within 10 days after the date of the order, Reuge is free not to deliver and is not bound by the order in any way.

Prices
5.1
Prices through the E-Boutique are set forth in the E-Boutique at the time of the order. Unless otherwise stipulated in the terms of the order acceptance, the prices are “DDP” according to the Incoterms 2020 of the International Chamber of Commerce.
5.2 The prices are indicated in the currency shown in the E-Boutique depending on user’s region.
5.3 Each visitor can adjust the management of cookies in his browser settings (see Terms of Use and Cookies).  

Delivery costs and custom duties
6.1 Reuge bears the delivery costs of the first delivery of the goods.
6.2 Deliveries outside Switzerland might be subject to additional custom duties or similar importation or other taxes for which the user might have to pay.

Payment
7.1 The user can pay his/her order by credit card only. Reuge however explicitly reserves its right not to accept certain payments or to offer other means of payment.
7.2 In case of payment through credit card, the credit card account is charged at the time of the confirmation of the order with the respective amount. The costs for the use of the credit card or for the bank transfer are at the sole expense of the user.

Delivery, delivery times and partners
8.1 Goods immediately available are delivered within maximum 10 working days after receipt of full payment. For specific and bespoke orders, including personalization of the melody, the delivery time is approximately 2 to 3 months after receipt of full payment. Should the delivery suffer some delay, Reuge informs the user in due time. In certain countries, Reuge delivers through its local partners and delivery times might be extended.
8.2 Delivery time is extended accordingly, should the delivery be affected by Acts of God, namely but without limitation strikes, confiscation, shortage, fire, floods, damage of machinery, riots or war. Should delivery be delayed for more than 6 weeks, user shall be entitled to withdraw from the contract without being entitled to any further compensation and/or damages.
8.3 Reuge delivers the goods through DHL or other courier services. Transport is insured at Reuge’s costs. Risk for destruction or deterioration of the goods passes to consumers domiciled in the European Union at the time of delivery to consumer or to a person representing him/her.
8.4 Should the ordered goods not be available, the advance payment is fully refunded by Reuge to user.

Inspection and Warranty
9.1 User shall inform Reuge within 10 days after receipt of the goods about any defects in quality or quantity and shall return the defective goods describing the defects in detail, with its warranty card, copy of the invoice and original packaging to the following address using DHL, UPS or FedEx carrier:

9.2 The warranty conditions of Reuge according to the warranty card further apply.

Right of return
10.1 Except for specifically engraved products or personalised products including the choice of specific melodies, consumers have the right to return the goods within 14 days after receipt using the “return-of-goods-form”. Consumer complies with the deadline when sending back the goods within 14 days (date of shipment) and respecting the conditions provided hereinafter. The costs for returning the goods are to be paid by consumer. The relevant form is available on https://www.reuge.com/shop.
10.2 The goods can be returned only after the written validation (e-mail is sufficient) by Reuge of the “return-of-goods-form”. The instructions for the return of the goods will be communicated in detail with the validation of the “return-of-goods-form”. The “return-of-goods-form” validated by Reuge, the original certificate of warranty and the original packaging using DHL, UPS FedEx or other courier services have to be returned within 14 days together with the goods. The goods have to be in perfect condition and not having been used. The goods have to be returned to the following address:

10.3 Reuge reserves the right not to take back the goods if the return is not first validated by REUGE upon acceptance of the “return-of-goods” form, or if the product is scratched or otherwise damaged or if the documentation is incomplete. In this case, Reuge is entitled to return the goods to the Consumer at Consumer’s costs. Reuge refunds the purchase price to Consumer the same way the purchase price was paid, should the return of goods be accepted by Reuge.
